Pennsylvania Requires No-Fault Coverage

There are a dozen states that have no-fault insurance rules. The Commonwealth of Pennsylvania is one of them (though it also has at-fault insurance requirements we’ll discuss below). This means that, after an accident, you’ll be required to submit a claim against your own personal car insurance policy to recover compensation. This is true regardless of who caused your car accident.

This means that you’ll be dealing with your car insurance company – at least at first. So, it will be important to know your policy limits and whether you’ve opted for limited tort or full tort insurance coverage.

What Are Pennsylvania’s Minimum Car Insurance Requirements?

Pennsylvania has some of the lowest thresholds for minimum auto insurance requirements in the United States.

Under state law, all drivers must purchase:

  • Medical Benefits Coverage: $5,000 per accident
  • Bodily Injury Liability Coverage: $15,000 per person, $30,000 per accident
  • Property Damage Coverage: $5,000 per accident

Some car insurance companies in Pennsylvania offer a $35,000 package, which satisfies the bodily injury and property damage requirements.

Remember, these are just minimums.

You have the option of purchasing higher limits and adding on other types of coverage, including:

  • Uninsured motorist coverage
  • Collision coverage
  • Comprehensive coverage
  • Rental car coverage
  • Gap coverage
  • Towing coverage.

When you buy a car insurance policy in Pennsylvania, you’ll have to choose one of two types of coverage: limited tort or full tort.

Why Does it Matter If I Have Limited Tort or Full Tort Coverage?

So what’s the difference between full tort and limited tort coverage, and why does it matter?

Limited tort insurance is less expensive but offers less in terms of benefits. Pain and suffering damages, for instance, aren’t available.

It also essentially waives your right to file a lawsuit or claim against the at-fault party’s insurance company. There are limited exceptions – but you’ll have to have sustained catastrophic injuries that meet certain requirements. You will face resistance if you attempt to file a claim. Having an attorney handling your claim will increase the odds of a successful result.

Full tort insurance is more expensive but gives you more options when it comes to (a) types of damages that are available and (b) pursuing compensation from the at-fault party.

When you choose a full tort policy, your right to file a lawsuit or Philadelphia insurance claim against a third party is unrestricted.

Our attorneys will help you identify the type of coverage you have and work toward a meaningful financial recovery.
