How much does it cost to hire a personal injury lawyer in Philadelphia?

Injury cases are handled on a contingency basis, meaning the fee is a percentage of what is recovered and there is nothing owed if there is no recovery. Workers’ compensation fees in Pennsylvania are capped by statute at 20% and require approval from a workers’ compensation judge.

How long do I have to file a claim in Pennsylvania?

Two years from the date of injury for most personal injury lawsuits. Claims against a government body generally require written notice within six months. Workers’ compensation has its own notice rules measured in days rather than years, so the answer depends on what kind of claim you have.

Should I talk to the other side’s insurance company?

You are not required to give a recorded statement to another party’s insurer. Those calls come early, before anyone knows how serious an injury is, and the answers get used later. Talking to a lawyer first costs nothing and changes what that call looks like.

Do you handle cases outside Philadelphia?

What’s Negligence & How Do I Prove It?

Most – but not all – accident cases in Pennsylvania are based on the tort of negligence. Basically, this means that someone gets harmed because another party was careless.

While only an experienced attorney can tell you if you have a case, you might have a legitimate claim if:

  • Someone else owed you a duty of care.
  • That person breached this duty of care, by not acting like a reasonable person would under the circumstances.
  • The person’s actions caused you to suffer an injury.

Can I Still Get Money If the Insurance Company is Blaming Me?

Yes – as long as you are not mostly to blame. Pennsylvania follows a modified comparative fault system with a 51% bar to recovery. Under the law, your right to receive compensation disappears when you’re assigned more than half of the blame.

Sharing some but not most of the blame will also affect your financial award. Your damages will be reduced in direct proportion to your degree of liability.

If you are assigned 40% of the blame, your damages will be reduced by 40%. (You’ll also be liable for 40% of damages sustained by other parties).
