West Philadelphia is one of the few places in the country where cars still share a travel lane with streetcars. That geometry produces crashes you will not see in the rest of the city, and it produces a legal deadline most injured drivers never hear about until it has passed.
SEPTA collisions and track-related crashes are a regular part of what we handle out here. If a transit vehicle or a rail surface was any part of your crash, the useful move is a phone call this week rather than next month. Zavodnick & Lasky Personal Injury Lawyers, +1 (215) 875-7030.
Was a SEPTA Vehicle Involved? Your Deadline Is Six Months, Not Two Years
A claim against SEPTA is a claim against a government agency, and it runs on a different clock. Under 42 Pa.C.S. § 5522, written notice generally has to be given within six months of the injury, and a case filed later without that notice can be dismissed outright.

The notice itself has required contents: the names and addresses of the claimant and the injured person, the date and hour of the accident, the location, and the name and address of the treating physician. Getting it filed correctly and to the right office is not a formality.
Two other things are different in a SEPTA case. Damages recoverable against a Commonwealth agency are capped by statute, well below what a private defendant would face. And sovereign immunity means the claim has to fit within one of the statutory exceptions, with the vehicle liability exception being the usual route for a bus or trolley collision.
None of this makes the claim hopeless. It makes it time-sensitive in a way an ordinary car accident is not. If a SEPTA bus, trolley or vehicle was anywhere in your crash, call +1 (215) 875-7030 this week.
What If a Poor Road Condition Contributed?

Then the defendant may be a government body rather than a driver, and the same six-month notice thinking applies.
Rail that has settled below the pavement, an unrepaired trench cut, a missing manhole cover, a signal that was dark, a sign obscured by growth, all examples of common road defects. Claims of this kind against a Commonwealth agency or a local agency are possible but narrow, they fit only within specific statutory exceptions, and they require proof that the responsible body knew or should have known about the condition.
Photographs taken the same day matter more here than in any other kind of case. Road defects get repaired, and a repair made three weeks after your crash erases the evidence of what it looked like when it caused it.
Lancaster, Baltimore and the Routes That Run in the Street
The Routes 10, 11, 13, 34 and 36 trolleys run in mixed traffic on Lancaster, Baltimore, Chester and Woodland Avenues before diving into the subway surface tunnel, and that creates hazards specific to these streets.

Track-related loss of control. Embedded rails and the gap beside them catch motorcycle and bicycle tires, particularly when wet. Riders go down without any vehicle touching them, which raises a road condition claim rather than a driver negligence claim.
Passenger boarding conflicts. Trolley riders step from the vehicle into a live travel lane. Drivers who pass a stopped trolley on the right create some of the most severe pedestrian injuries in this part of the city.
Corridor turning crashes. Lancaster Avenue crosses the street grid diagonally, producing acute-angle intersections where sightlines and expectations do not match the rest of the city’s right angles.
52nd Street and Market Street commercial traffic. Double-parked delivery vehicles, buses pulling from the curb, and pedestrians crossing mid-block under the elevated line.
How Long Do You Have Against a Private Driver?
Two years from the date of the crash for most Pennsylvania injury lawsuits, under 42 Pa.C.S. § 5524.
The trap in West Philadelphia is a crash with more than one potential defendant. If a private driver and a public agency were both involved, the six-month notice governs the public side even though the private claim has two years. Working from the longer deadline is how the government defendant quietly drops out of the case.
Trolley, Bus and City Vehicle Questions
I was a passenger on a SEPTA bus when it was hit by a car. Who do I claim against?
Potentially both, and passengers are almost never assigned fault, which makes these strong liability cases. Passenger claims also fall outside a limited tort restriction, because the election applies to occupants of private passenger vehicles rather than buses. Notice deadlines still apply to the SEPTA side.
My motorcycle went down on trolley tracks and no other vehicle was involved. Is there a claim?
Possibly, depending on the condition of the track and pavement and who was responsible for maintaining it. These cases turn on whether the surface had deteriorated beyond a normal condition and whether the responsible body had notice of it. They also run on the shorter government notice deadline, so they cannot sit.
A city trash truck sideswiped my car on Baltimore Avenue. Is that the same as a SEPTA claim?
Similar in structure, different in the details. A municipal defendant falls under the local agency provisions rather than the Commonwealth ones, with its own cap and its own exceptions. The six-month notice thinking applies to both, which is the practical point.
The trolley driver said it was my fault and SEPTA’s investigator called me the next day. Should I give a statement?
You are not obligated to give a recorded statement to the other side’s investigator, and a call that fast usually means they are working from the operator’s account and the vehicle’s onboard recording. Get your own account documented first, and understand what those recordings show before you talk about what happened.
The Clock on a Government Claim Has Already Started

Most people spend the first two months of a claim treating and waiting to hear from an adjuster. If a public agency was involved, that is a third of your notice period gone.
Tell us what vehicles were involved and where. If any of them belonged to SEPTA or the city, we move on the notice the same week. +1 (215) 875-7030.
